01  Acceptance and changes

By creating an account or using the Service, you confirm that you have read, understood and agree to be bound by these Terms. If you do not agree, do not use the Service.

We may update these Terms from time to time. Where a change is material, we will make reasonable efforts to notify you through the Service or by email before it takes effect. Continued use of the Service after a change takes effect means you accept the revised Terms. If you do not accept them, you must stop using the Service and may delete your account.

02  Eligibility

You must be at least 18 years old to use the Service. By using it you confirm that you meet this requirement and that the information you provide is accurate.

You must use the Service only in a jurisdiction where it is lawful to do so. If you are accessing the Service from a territory where use is prohibited or where you are not old enough to consent to the processing of your data under applicable law, do not access the Service.

03  Nature of the Service

The Service is a platform for meeting other people through live camera chat. Some features operate in a demonstration mode: a video is played back rather than a live connection being established with another person, and text messages are displayed locally on your own device rather than being delivered to anyone.

You acknowledge and agree that:

• the Service does not verify the identity, age, intentions or claims of any other user;
• people you encounter may misrepresent themselves, and content you see may be inaccurate, misleading, offensive or unlawful;
• we do not arrange, supervise or take responsibility for any interaction between you and any other user;
• any profile, photograph, video or other material shown in the photo gallery is provided by the Operator or its licensors for display within the Service only.

You interact with other users at your own risk. We strongly recommend that you take sensible precautions when meeting or communicating with anyone online.

04  Accounts and virtual items

Accounts

You are responsible for activity that occurs under your account and for keeping your access details confidential. You must not share your credentials or allow others to use your account. Tell us promptly if you suspect unauthorised access.

You can request deletion of your account at any time by contacting us at the address in section 13. We may suspend or terminate accounts that breach these Terms, and we may preserve records where required by law or necessary to resolve a dispute.

Virtual items

Diamonds are a virtual item earned within the Service and used only to unlock optional content such as additional photographs. They have no cash value, cannot be exchanged for money or anything of monetary value, cannot be transferred to another user, and cannot be purchased back or refunded, except where the law requires otherwise.

Diamonds have no value outside the Service and may be removed if an account is terminated for a breach of these Terms. We may change the ways diamonds can be earned, the content they unlock, and the amounts required. We may adjust or remove features, and may change the Service at any time.

05  Acceptable use

You must not, and must not permit anyone using your account to:

• behave in any way that is unlawful, or that infringes the rights of another person;
• display or distribute content that is obscene, sexually explicit, violent, hateful, racist, or that promotes self-harm, harassment or illegal activity;
• impersonate any other person or entity, or falsely claim an affiliation;
• record, capture, stream, screenshot, mirror or otherwise copy any video call, photograph or other content without the consent of the person shown;
• upload or transmit content that you do not have the right to use, or that infringes copyright, trademark, publicity or privacy rights;
• use bots, automation, scraping tools or other means to extract content or to generate artificial traffic;
• reverse engineer, decompile, disassemble, or attempt to obtain the source code of the Service other than to the extent such restriction is prohibited by law;
• probe, scan, overload, attack or test the vulnerability of the Service without our prior written permission;
• circumvent, disable or interfere with any security, moderation, rate-limit or access control, or attempt to obtain virtual items other than by legitimate use;
• use the Service to solicit, recruit, advertise or transmit commercial content to other users;
• upload malware, or any code designed to harm or gain unauthorised access.

Any use of the Service by a person under 18, or any sexualised depiction of a person who appears to be under 18, is strictly prohibited and will result in immediate termination and referral to the relevant authorities where applicable.

06  Intellectual property

The Service, including its software, design, layout, graphics, text and branding, is owned by or licensed to the Operator and is protected by copyright, trademark and other intellectual property laws.

We grant you a personal, non-exclusive, non-transferable, revocable and limited licence to access and use the Service for your personal, lawful use. You may not copy, reproduce, modify, publish, sell, sublicense or create derivative works from any part of the Service, except where expressly permitted by law.

You retain all rights in the content you upload. You grant us a non-exclusive, worldwide, royalty-free, revocable licence to host, reproduce, display and distribute that content solely for the purpose of operating the Service.

07  Third-party links and promotions

The Service may contain links to, or paid promotions for, third-party websites. These are provided for convenience only.

We do not control and are not responsible for the content, products, services, availability, security or privacy practices of any third party. A link or promotion does not imply that we endorse or are affiliated with the destination. Your dealings with a third party are between you and that third party, at your own risk.

08  Reporting, moderation and enforcement

You can report content or conduct you believe breaches these Terms by emailing us at the address in section 13. Please include enough detail for us to locate the content, such as a description, the approximate time, and the username of the person involved.

We may, at our sole discretion and without prior notice: remove content; restrict or suspend access to the Service; suspend or terminate an account; and preserve or disclose records where required by law, or where we reasonably believe there is a risk to the safety of any person.

We are not obliged to provide you with the reason for a moderation decision, but we will consider reports in good faith.

09  Termination

You may stop using the Service and request deletion of your account at any time. We may suspend or terminate your account, without notice, if you materially breach these Terms, or if required by law or to protect the safety of the Service or its users.

On termination, your right to use the Service and any diamonds you hold ends immediately. Provisions that by their nature should survive termination survive, including intellectual property, disclaimers, limitation of liability and indemnity.

10  Disclaimers

The Service and all content on it are provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy and uninterrupted availability.

We do not warrant that the Service will be error-free, that any interaction will lead to a relationship, or that content shown is accurate, suitable, safe or lawful. Content belongs to, or is supplied by, third parties and is not reviewed by us.

11  Limitation of liability

To the fullest extent permitted by law, the Operator and its affiliates, officers, employees and agents will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, data, goodwill or other intangible losses, arising out of or related to your use of, or inability to use, the Service.

To the fullest extent permitted by law, our total aggregate liability arising out of or relating to the Service will not exceed the greater of the amount you paid us in the twelve months preceding the event giving rise to the claim, or 50 USD.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for death or personal injury caused by negligence, fraud, or any other liability that applicable law does not permit us to disclaim.

12  Indemnity

You agree to indemnify, defend and hold harmless the Operator and its affiliates, officers, employees and agents from and against any claim, demand, loss, damage, cost or expense (including reasonable legal fees) arising out of your use of the Service, your breach of these Terms, your violation of any law or the rights of a third party, or your uploading or sharing content.

13  Governing law and contact

These Terms are governed by the laws of the jurisdiction in which the Operator is established, without regard to its conflict of law rules. The courts of that jurisdiction have exclusive jurisdiction over any dispute arising from these Terms, except where applicable law gives you the right to bring proceedings locally.
